LEGAL BASIS OF TURKMEN NEUTRALITY

 

Turkmenistan had its Independence in 1991 and has recognized as an Independent State in the international sphere. The Constitutional Law of Turkmenistan adopted on May 18, 1992, defined the political structure of the Turkmen State and declared it a democratic, legal, and secular State.

On March 2, 1992, at the 82nd Meeting of the 46th Session of the UN General Assembly, Turkmenistan was the member of the United Nations.

Turkmenistan has a permanent Neutrality status recognized by the international community and legally secured. The permanent Neutrality status of Turkmenistan has recognized in the Resolutions entitled «Permanent Neutrality of Turkmenistan» adopted by the United Nations General Assembly on December 12, 1995 with the support of 185 states, second time on June 3, 2015 with the support of 193 states and for the third time ­– on March 21, 2025 declared the «International Year of Peace and Trust». Our country is the only State has enshrined the legal status of Neutrality in its Constitutional Law.

Turkmenistan's permanent Neutrality is «recognized» as its origin, «permanent» in form, and «positive» in meaning, is an international legal status recognized by the world community and secured by a historic Resolution.

Turkmenistan as a full-fledged subject of the world community adheres permanent Neutrality principles in its foreign policy principles; non-interference in the internal affairs of other countries, renunciation of the use of force and participation in military alliances and formations, promotion peaceful, friendly and mutually beneficial relations with the countries of the region, as well as all States of the world.

On February 2, 2017, within the framework of the 71st Session of the UN General Assembly, a Resolution has adopted to declare December 12 as the «International Neutrality Day». This document confirms that the Turkmen model of Neutrality has become an effective tool for ensuring global peace and security, effective dialogue and cooperation, and strengthening friendly and respectful relations between States and nations.

In 2007, when the National Leader of the Turkmen people, Chairman of the People's Council of Turkmenistan, Honorable Gurbanguly Berdimuhamedov, made His first Speech at the Session of the General Assembly of the United Nations, He presented to the League of Nations the main directions of Turkmenistan's policy and its future prospects. Our Neutral country, steadfastly committed to the international commitments it has undertaken, recognized as a peace-making center for the entire region and the world.

On December 10, 2007, with the founding initiatives of the National Leader of the Turkmen people, Hero Arkadag, and with the unanimous support of all countries in the region, and later by the all members of the United Nations, the Headquarter of the UN Regional Center for Preventive Diplomacy for Central Asia has ceremonially opened in Ashgabat.

The Regional Center for Preventive Diplomacy for Central Asia put forward proposals aimed at transitioning to effective forms of cooperation to ensure peace, security, and sustainable development in the region by using currently necessary preventive diplomacy tools.

In order to expand the opportunities of women, special attention has paid to gender policy in Turkmenistan. In this regard, effective cooperation has carried out with foreign countries and international organizations. By the initiative of our Hero Arkadag, numerous and diverse events were held within the framework of Turkmenistan's Chairmanship of the Central Asian Women's Dialogue in 2022. The Central Asian Women's Dialogue plays an important role in implementing the UN's «Women, Peace and Security» program on gender equality, holding consultations among women on regional issues, strengthening inter-parliamentary relations, exchanging experience in legislative work, and developing friendly and fraternal relations between States and nations. This is clear evidence by the fact, the Women's Dialogue sessions have become more regular, and its forms and effectiveness have increased. In this regard, at the initiative of our Hero Arkadag, the Dialogue of Women of Central Asia and Russia held on May 13, 2022, and the Declaration adopted as results of the meeting has distributed among the member States of this organization as a UN document.

The Mejlis (Parliament) of Turkmenistan is a unicameral representative body that exercises legislative power. The Mejlis adopts the Constitution, Laws, and resolutions. The Mejlis of Turkmenistan consists of 125 deputies. There are 8 committees in the Mejlis.

The following laws adopted by the Mejlis of Turkmenistan are in force, which determine the legal basis for the permanent Neutrality of our country and various aspects of international relations with foreign states and international organizations, namely:

- Law of Turkmenistan «on State property of Turkmenistan located in foreign country»;

- Law of Turkmenistan «on the Status of the diplomatic missions of Turkmenistan in foreign countries»;

The development of inter-parliamentary relations is one of the key directions of Turkmenistan's foreign policy. In this regard, the Mejlis of Turkmenistan attaches great importance to the development of cooperative relations with parliaments of countries around the world. Currently, 51 inter-parliamentary friendship groups established on a bilateral basis with the parliaments of countries around the world operate in the Mejlis.

The Parliament of Turkmenistan has been a member of the Parliamentary Assembly of the Organization for Security and Cooperation in Europe since 2014. Representatives of the Mejlis of Turkmenistan regularly participate in the meetings and events of this parliamentary organization. In the past period, the Mejlis of Turkmenistan has held several joint events with the OSCE Parliamentary Assembly.

In 2023, the Mejlis of Turkmenistan, together with the OSCE Parliamentary Assembly, held a Central Asian regional conference in Ashgabat entitled «The Role of Neutral States in Strengthening Security, Stability and Dialogue in the OSCE region. » 

In 2024, joint conferences held in Ashgabat entitled «Parliamentary Diplomacy within the OSCE: Dialogue as a Tool for Building Bridge for a Secure and Peaceful Future. »

In 2023, a representative of the Mejlis of Turkmenistan has appointed to the Young Parliamentarians' Network of the Parliamentary Assembly of the Organization for Security and Cooperation in Europe.

The Mejlis of Turkmenistan has been a member of the Inter-Parliamentary Union (IPU) since 2017. The Mejlis actively participates in the activities of the Inter-Parliamentary Union aimed at uniting the efforts of parliamentarians around the world to ensure sustainable development. The IPU serves as a broad platform for parliamentarians from different countries to exchange experiences in legislative work and discuss important issues of common interest of the time.

The Parliament of Turkmenistan holds meetings with the European Parliament within the framework of a bilateral dialogue. Up to date, 8 meetings of the «Turkmenistan - European Union Parliamentary Dialogue» format have been held with the participation of representatives of the Mejlis of Turkmenistan and members of the European Parliament.

In 2020, the establishment of the Group of Friends of Neutrality in the interests of peace, security and sustainable development within the framework of the United Nations, by the initiative of Turkmenistan, glorified our country's humanitarian foreign policy and the Turkmen principle of Neutrality in the world arena. The first meeting of the Heads of Parliaments of the member countries of the Group of Friends of Neutrality, entitled «The Role of Parliamentary Cooperation in Strengthening Peace and Dialogue», held in Ashgabat on February 15, 2024. Currently, the Group of Friends of Neutrality includes more than 20 member states.

In the new historical era, under the wise leadership of the Honorable President of Turkmenistan Serdar Berdimuhamedov, further enhance the State's global position, to conduct a domestic and foreign policy based on the principles of international cooperation, trust and friendship, widely promote and popularize international initiatives for the benefit of all mankind, commemorate the 80th Anniversary of the founding the UN, the remarkable 30th Anniversary of Turkmenistan's permanent Neutrality, as well as the unanimous adoption by the UN General Assembly of the Resolution «2025 - the Year of International Peace and Trust» at the initiative of Turkmenistan, and based on the wonderful poem «Turkmenistan - the Homeland of Peace and Trust», which created from the sharp intellect and precious wisdom of our Hero Arkadag and widely reveals the value of peace and trust, 2025 was declared the «Year of International Peace and Trust» by the Resolution of the Mejlis of Turkmenistan.

Turkmenistan is putting forward and implementing great initiatives to strengthen Peace and Trust in the world, developing friendly and mutually beneficial relations. In this regard, the books were born from the precious wisdom of our Hero Arkadag «Neutral Turkmenistan», «“Music of Peace Music of Friendship, Brotherhood», «Turkmenistan - the Land of Neutrality» are invaluable assets.

Adhering to the principle of permanent Neutrality, Turkmenistan guided by the great doctrine and scientific philosophy of our National Leader of the Turkmen people Hero Arkadag «Dialogue is a guarantee of peace» makes a significant contribution to the peaceful development of international relations, ensuring peace, trust, global security and sustainable development in the world.
